Customer Terms - Terms and Policies Specific to Receiving Services - 619-955-6700

By receiving services, you grant that you have read, understand, and agree to the following

  • STUDENT TERMS OF SERVICE (rev. Oct 2009)
  • All provisions in the TERMS OF USE AGREEMENT are applied to this Terms of Service Agreement. If any provision is found to be in conflict with the Terms of Use Agreement, the provision in this Terms of Service Agreement will supersede.
  • While the goal of our service is to increase grades and scores on tests, exams, report cards, diplomas, and/or transcripts, it is beyond our control to directly affect these outcomes, therefore we make no warranty that a student's academic performance will increase due to the use of our services or materials provided. The tutors should not be held responsible for covering every topic which might occur on a test or exam, nor is the tutor's knowledge on certain topics guaranteed to be free of errors. The Company cannot be held accountable for mistakes on the student's class work, homework, test, exams, etc. We wish it was possible to make such guarantees, but student performance and tutor perfection are simply beyond The Company's control.

    The customer agrees to pay for services provided by The Company and/or its tutors as outlined on the PRICES PAGE of this website along with any related fees associated with additional goods or services, late payments, session cancellations, refunds, and any other reasonable charges The Company feels necessary to impose. The customer is encouraged to check their account regularly to ensure the accuracy of sessions reported by the tutor. The customer has 5 days from the date of a tutoring session to challenge its accuracy, afterwards the tutor will be compensated for the reported time and the customer charged for those sessions.

    Stagnant Accounts: We define a school year as starting on Sept 1st, and ending on Aug 31st of the following year. Accounts are only considered stagnant if no payments have been made within the current school year and the student has not received services within the last 30 days. Stagnant accounts are reduced by the maintenance fee of 1 hour every 30 days, however maintenance fees are not charged during September to provide extra time to connect with a tutor after the summer months.

    Refund Policy: All services that have been performed, or cancelled without at least 24 hours notice, will be charged to the account. The customer has 30 days from when the payment is made to request a full refund if we are not able to find a tutor to provide services. The refund amount is the amount collected, minus the purchase price of the hours used from the last purchase, minus a $35 processing fee. Hours used are charged at the current package rate without any promotion discounts.

    Negative Balances: After a 15 day grace period, any account with an overdue balance will be charged a $10 late fee every 30 days until resolved. If a negative account is not resolved after 90 days, collection proceedings will be initiated, a one time collection fee of $30 is charged, monthly late fees continue, and future services likely denied. If The Company must use a Collections Agency and/or attorney to remedy an outstanding balance, the customer agrees to pay for any additional charges arising from such actions. Payments will be applied toward late fees then toward the original overdue balance.

    Our tutors are Independently Contracted Workers who are solely responsible for their own actions. While The Company does take many steps to ensure the proper intent of our educators, it is not legally bound to the misconduct of its tutors. Any such legal action is to occur between the customer and the tutor only. Tutors and customers agree to indemnify and hold The Company, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of any content on the website, communication with The Company, or services provided by The Company and/or the tutors, whether by negligence or willful conduct. Tutors and customers also agree to not hold The Company liable for any loss in property or data of the tutor and/or customer.
